What is Multidistrict Litigation?

Multidistrict Litigation (“MDL”) is a legal procedure designed to expedite the handling of complex cases. Often, hundreds or even thousands of plaintiffs will allege injuries from the same cause and bring numerous civil actions in many different courts across the country.

If these individual cases all share common questions of fact, a special body within the U.S. federal court system, called the Judicial Panel on Multidistrict Litigation (“JPML”), may decide to consolidate the entire group of cases into an MDL. Once an MDL is established, all existing subject cases are transferred to the designated MDL court.

Subsequent cases may also be filed directly into the MDL court. Each MDL court is presided over by a single judge. Typically, the MDL judge will appoint what is called a Plaintiffs’ Steering Committee (“PSC”). The PSC is a small group of experienced plaintiffs’ attorneys which handles pre-trial proceedings and discovery on behalf of all plaintiffs in a given MDL.

Such cases require in-depth analysis of technical issues which affect a large number of people who have suffered the same or similar injuries caused by the same drug or device.

Consolidating these cases into MDLs allows for increased judicial consistency since one judge will decide all pre-trial and discovery issues for each group of cases. In addition, centralizing the discovery of issues which are common to all cases is more cost-effective because such investigation will benefit all involved plaintiffs as a group, rather than on an individual basis.
